Mesozoica Terms and Conditions

These Terms and Conditions ("Terms") form a legally binding agreement between you and the operator of Mesozoica ("Mesozoica", "we", "us", or "our") for access to and use of the Mesozoica mobile app, APIs, and related services (collectively, the "Service").

By installing, accessing, or using the Service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, do not install or use the Service.

1. Eligibility and Accounts

1.1 You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may only use the Service with permission and supervision from your parent or legal guardian where required by applicable law.

1.2 You must provide accurate account information and keep it updated.

1.3 You are responsible for safeguarding your account credentials and for all activity under your account.

1.4 You may not transfer your account without our prior written consent.

1.5 You may not create accounts by automated means, use another person's credentials, or impersonate another individual or entity.

1.6 We may require identity, ownership, or account-security verification steps when investigating fraud, abuse, legal complaints, or account compromise.

2. Service Description

2.1 Mesozoica is a location-based paleontology game. Players discover archive and field sites, use tools, collect fossils and dinosaurs, progress skills, and browse scientific catalogs.

2.2 Scientific catalog content is compiled from public sources and automated enrichment. It is provided for gameplay and education. It is not a professional scientific, medical, or surveying opinion.

2.3 The Service may change over time. We may add, modify, pause, or remove features without prior notice where legally permitted.

2.4 Availability may vary by region, device, operating system, and app store policies.

2.5 The current version of the Service is free to use. If paid features are added later, they will be described in the app and in updated Terms.

3. Location, Health, and Device Permissions

3.1 Map discovery, site documentation, and walk XP require location permission. Background location is optional and used only to continue discovery, documentation, and walk XP while the app is not in the foreground.

3.2 Walking-distance features may read Health / Health Connect distance data if you grant that permission. You can refuse or later revoke these permissions in system settings; some gameplay features will then be limited.

3.3 You are responsible for using the Service safely outdoors. Do not trespass, ignore traffic or local rules, or put yourself or others at risk while playing.

4. User-Generated Content (UGC)

4.1 "UGC" means any content you upload, create, submit, display, or otherwise make available through the Service, including profile text, profile photos, names, assistant questions, and reports.

4.2 You retain ownership of your UGC. You grant Mesozoica a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, cache, reproduce, adapt, process, format, transmit, display, and distribute UGC solely to operate, secure, moderate, maintain, improve, and provide the Service.

4.3 You represent and warrant that you have all rights needed to submit your UGC, that it does not infringe rights of others, and that it complies with these Terms and applicable laws.

4.4 You remain solely responsible for your UGC and for consequences of sharing decisions made through available privacy and social controls.

5. Prohibited Content and Conduct

You may not use the Service to create, upload, share, request, distribute, or promote content or behavior that includes:

• Illegal activity or instructions for illegal activity.
• Child sexual abuse material, child exploitation, or grooming behavior.
• Sexual violence, non-consensual intimate imagery, or exploitation.
• Terrorist content, violent extremism, or credible threats of violence.
• Harassment, hate speech, bullying, stalking, or targeted abuse.
• Doxxing, privacy invasion, or unauthorized disclosure of personal data.
• Impersonation, identity fraud, phishing, scams, or deceptive practices.
• Malicious software, harmful code, or attempts to disrupt systems.
• Copyright, trademark, or other intellectual property infringement.
• Spam, coordinated inauthentic behavior, or artificial amplification.
• Cheating, account sharing for abuse, or automated farming of gameplay rewards.

You may not:

• evade enforcement, safety restrictions, or account actions;
• create replacement accounts to bypass suspensions or blocks;
• abuse reporting systems with malicious or knowingly false reports;
• attempt to access or disclose content that is not authorized for you.

6. Moderation, Enforcement, and Appeals

6.1 We may use automated and human review to detect and act on violations.

6.2 Where lawful, we may warn, remove content, limit visibility, restrict features, suspend accounts, or terminate access for policy, safety, or legal violations.

6.3 We may preserve and disclose relevant information where required by law, valid legal process, or to protect rights, safety, and platform integrity.

6.4 If your content or account is actioned, contact contact@mesozoica.app to appeal where required by law and safety constraints.

7. Intellectual Property and Copyright Complaints

7.1 The Service, excluding user-owned UGC, is owned by Mesozoica or its licensors and protected by applicable laws. Scientific source material remains subject to the rights of its original publishers.

7.2 If you believe content infringes your copyright or other IP rights, contact contact@mesozoica.app with identification of the work, the allegedly infringing material, your contact details, and a good-faith statement of authority.

7.3 We may remove allegedly infringing content and may terminate repeat infringers where appropriate.

8. Privacy and Data Handling

8.1 Our Privacy Policy explains how we collect, use, share, and retain personal data.

8.2 By using the Service, you acknowledge processing of data as described in the Privacy Policy.

9. Third-Party Services

9.1 The Service integrates third-party sign-in, maps, hosting, and other providers.

9.2 We are not responsible for third-party services, websites, or terms; your use of those services is governed by their policies.

10. Service Availability and Changes

10.1 We do not guarantee uninterrupted, secure, or error-free operation.

10.2 We may suspend access for maintenance, security, abuse prevention, legal compliance, or technical reasons.

10.3 We may deploy updates required for safety, legal, and interoperability reasons. Continued use may require installing updated versions.

11. Disclaimers

11.1 The Service is provided on an "as is" and "as available" basis to the fullest extent permitted by law.

11.2 We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimers are prohibited by law.

11.3 Catalog facts, maps, site locations, and generated field sites may be incomplete, simplified, or fictionalized for gameplay. Do not rely on them for navigation, excavation, or scientific work.

12. Limitation of Liability

12.1 To the maximum extent permitted by law, Mesozoica and its affiliates, officers, employees, and agents are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, goodwill, or business interruption, or for injury or property damage arising from outdoor play.

12.2 To the extent liability cannot be excluded, our aggregate liability for claims arising from or relating to the Service will not exceed the greater of:

• the amount you paid to us for the Service during the 12 months before the claim; or
• EUR 100.

12.3 Nothing in these Terms excludes or limits liability that cannot be excluded by law, including certain rights for consumers.

13. Indemnification

You agree to defend, indemnify, and hold harmless Mesozoica and its affiliates, officers, employees, and agents from claims, liabilities, losses, and expenses (including reasonable legal fees) arising from your UGC, your use of the Service, or your violation of these Terms or applicable law.

14. Suspension and Termination

14.1 You may stop using the Service at any time and may delete your account in Profile → Settings → Account.

14.2 We may suspend or terminate your access if you violate these Terms, create legal/safety risk, or where required by law.

14.3 Clauses that by nature should survive termination survive termination.

15. Governing Law and Disputes

15.1 These Terms are governed by the laws of Belgium, excluding conflict-of-laws principles.

15.2 If you are a consumer residing in the EU/EEA/UK/Switzerland, mandatory consumer protections in your country of residence remain applicable.

15.3 Courts of Brussels, Belgium have non-exclusive jurisdiction, subject to mandatory consumer forum rights.

16. Changes to These Terms

16.1 We may update these Terms to reflect legal, security, or product changes.

16.2 We will update the "Last updated" date and provide additional notice where legally required.

16.3 Continued installation, access, or use after updated Terms become effective constitutes acceptance of the updated Terms.

• Outdoor-play and location-game safety wording.
• Notice-and-takedown process requirements.
• Data retention and law-enforcement handling.
